A former Evansville Police officer who was fired last year, takes his appeal to court not in Vanderburgh County.

The Police Merit Commission terminated Steve Hicks last December. He was the department's 2012 Officer of the Year.

Officials say Hick's petition for judicial review has been moved to Gibson County. We're told attorneys representing the city did not object to the change of venue.

Now, they're waiting to see if the judge will take the case. If he doesn't, officials say the case will remain in limbo until a new judge can be found. Attorneys say until a new judge is selected, the case will be at a standstill.

In the lawsuit, Hicks calls his termination "arbitrary and capricious." Back in December, the merit commission found Hicks guilty of inappropriately interacting with a female bartender while on duty.
