Indiana Supreme Court Strikes Down Evansville Smoking Ordinance

The Indiana Supreme Court has struck down Evansville's smoking ban in a 3-2 ruling.

A Chief Justice wrote, "Today we hold that this clause invalidates an Evansville ordinance expanding the city's smoking ban to bars and restaurants but exempting its only riverboat casino."

In the ruling, the Indiana Supreme Court said the ordinance's exemption of Tropicana Evansville, formerly known as Casino Aztar, was in violation of the state's 'Equal privileges and Immunities Clause.'

Close to 30 businesses, all private bars and taverns in the River City, joined together to file these suits.
