UPDATE: Verdicts Delivered in EPD Disciplinary Hearing

UPDATE: Officer Nick Henderson will NOT be terminated. 21 day suspension UPHELD.

Mark DeCamps' suspension reduced to 7 days. NO termination.

Sgt. Kyle Kassel will be reinstated to full pay, no suspension, no demotion.

 

PREVIOUS STORY

The careers of two Evansville Police officers and the rank of another are on the line Thursday as the disciplinary hearing for the officers accused of misconduct in an October arrest finally gets underway.

Officers Nick Henderson, Mark DeCamps, and Sgt. Kyle Kassel have been accused of multiple department violations stemming from the controversial arrest of Mark Healy in late October.

Thursday's meeting got underway around 9 a.m. and it's standing room only. People have had to spill out into the hallway and watch the live stream of the meeting online.

Officers Henderson and DeCamps face termination and Sgt. Kassel faces demotion in connection with Healy's arrest.

Attorneys for the department and the individual officers laid out their cases in opening statements.

The department's attorney said his case is very straight forward and the evidence supports the statements.

The attorneys for the officers fired back – blasting the administration, the chief's recommended discipline, and the internal investigation.

First Witness

The first witness called was Officer Henderson, the wearer of the body camera that showed the arrest.

The footage showed Henderson appearing to strike Healy after Henderson was pricked by a dirty needle in Healy's pocket. Healy has a communicable disease.

The department's attorney grilled Henderson on some of the alleged inconsistencies in his paperwork.

There was a point in time when Henderson became very emotional when talking about his immediate thoughts after being stuck by the needle.

He began to cry when talking about his family and his fear that he might have contracted some sort of disease.

Second Witness

Officer Mark DeCamps has also taken the witness stand on Thursday.

Officer DeCamps said he never instructed Henderson or Craig to stop kicking or using force against Healy.

However, DeCamps told internal affairs that he wanted to 'distance himself' from what happened.

DeCamps admitted that he did not fully read the probable cause affidavit that he signed.

DeCamps said he did not know the inaccuracies contained in the affidavit that he signed until 4 days later.

 

Latest Witnesses

After lunch, Chief Billy Bolin was called to the stand by the police department.

Chief Bolin made the disciplinary recommendations.

Bolin talked about how the decision to recommend Henderson's termination was difficult, especially after Henderson's 25-year career without a major incident.

The department also called the Sergeant in charge over the department's records management system.

He testified that Officer DeCamps was logged into the computer when changes were made to the probable cause affidavit the day after Healy was arrested.

DeCamps initially stated that he had not reviewed the affidavit prior to signing it.
