'Gun at the Zoo' Lawsuit Still in Play

The Indiana Court of Appeals slams the city of Evansville during a second attempt to toss out a 2011 lawsuit.

Benjamin Magenheimer claims he was removed from Mesker Park Zoo for having a handgun holstered on his hip.

Magenheimer claims Evansville violated state law, which generally bars political subdivisions from regulating firearms.

That law went into effect a few months before the incident. At the time, Evansville's municipal code prohibited guns in city parks.

Just last year, the same court of appeals ruled in favor of Magenheimer, saying his case can go to trial.

It's unclear if a trial date has been set.
