Attorney General's Guidelines on How to Handle Same-Sex Cases in Indiana

The Indiana Attorney General's office is offering guidance to County Clerks who are unsure how to address the latest court stay in Indiana same-sex marriages.
The Indiana Attorney General's office is offering guidance to County Clerks who are unsure how to address the latest court stay in Indiana same-sex marriages.
Guidelines include:
  • The validity of the marriages are undetermined and maybe determined by a court later.

  • Clerks should refrain from issuing additional same-sex marriage certificates.

  • Clerks follow their normal refund practice if a same-sex marriage certificate refund is requested

The ban on same sex marriage was overturned last Wednesday but was brought to the US. 7th Circuit Court of appeals just two days later.
There's  still no word on when the US 7th circuit court of appeals will have a decision.
However,  in Kentucky, a federal judge rules same-sex couples have a right to marry in the state. The judge did put the ruling on hold pending a decision by a higher court.
