Former Henderson Mayor and current City Commissioner Tom Davis enters a not guilty plea for impersonating a police officer. The incident dates back to last September.

Kentucky State Police say it may have started with a road rage incident. Investigators say Davis pretended to be a police officer and asked two men to show him their ID's.

This morning, the Henderson County Commonwealth Attorney recused himself from the trial because of his relationship with Davis.

"I have a long-standing personal relationship with Mr. Davis," said Bill Markwell. "In light of that and statute, I have asked for the appointment special prosecutor, and they assured me that would be done very shortly."

It will will be decided if a special judge will also be selected.
