Eyewitness News reported on Tuesday that Ed Bay, who owns and operates the Shoney's in Henderson and Owensboro, filed a lawsuit in 2010 against Shoney's North America for breaching their license agreement.

The owner says the lawsuit, which is still pending in court, has caused such a financial burden, he can no longer continue to keep the restaurants open.  

In a statement Tuesday, Shoney’s North America said it’s working to keep the Owensboro and Henderson franchises open.

Eyewitness News reached out to Sholand, LLC and tried to contact Ed Bay, but did not receive a response.
