Former Henderson mayor and current City Commissioner Tom Davis enters a not guilty plea for impersonating a police officer. The incident dates back to last September. Kentucky State Police say it may have started with a road rage incident.

Investigators say Davis pretended to be a police officer and asked two men to show him their I.D.'s. Tuesday morning Hon. Bill Markwell, Henderson County Commonwealth Attorney, recused himself from the trial because of his relationship with Davis.

"I have a long-standing personal relationship with Mr. Davis. In light of that and statute, I have asked for the appointment of a special prosecutor and they assured me that would be done very shortly," said Markwell.

It will be decided Monday if a special judge will also be selected.
