As we first reported Monday, 18-year-old Colin Phillips was charged with contributing to the delinquency of a minor, which is a Class A misdemeanor.

Phillips is already enrolled in a diversion program. However, we're told his charge could be amended.

Phillips says he showed his 17-year-old friend an e-cigarette on school property. The school's liaison officer wrote Phillips a ticket, which resulted in further prosecution.
