INDOT officials are suing Monroe County over issues they say could delay completion on Interstate 69.
Monroe County has a noise ordinance in place from 10pm to 6am everyday.
INDOT says it's crews do a lot of night construction to avoid rush hour traffic.
Right now contracts are in place to continue the 4th and 5th phase of I-69 from Crane to Bloomington.
If the noise ordinance remains, transportation officials say the I-69 project will take longer to finish and disrupt traffic. The also say it will raise costs because of having to paying more to employees and by using more equipment
A hearing is set for this afternoon. INDOT plans to ask for a temporary restraining order on the ordinance until the lawsuit plays out.
