In December, Justices will consider whether to reinstate the death penalty for 39-year-old Robert Keith Woodall. Woodall pleaded guilty in 1998 to abducting, raping and killing 16-year old Sarah Hansen in Greenville.
The original death sentenced was overturned, a decision which was later upheld by the U.S. 6th Court of Appeals.
The high court must decide if an error in jury instructions means Woodall's life should be spared, or whether he should return to death row, as prosecutors argue.
The justices will also weigh whether the appeals court followed precedent regarding how it reviewed the state court decision.
