The U.S. Court of Appeals for the Seventh Circuit overturned the death penalty case of Paul McManus.
McManus was found guilty in 2002 and sentenced to death for shooting and killing his wife and two children in late February 2001. But the appeals court found McManus was forced to appear before the jury in a “drug induced stupor.”
The ruling means McManus could be released if prosecutors choose not to have a new trial. However, Vanderburgh County Prosecutor Nick Hermann says he is already preparing for a new trial if an appeal isn’t filed in the U.S. Supreme Court.
