A man crashes into a tree after allegedly trying to reach for a cellphone to answer a call.

The Vanderburgh County Sheriff’s Office says it happened in the 8100 block of Darmstadt Road near Mohr Road around 12:30 p.m. Saturday.

Sheriff’s deputies say Michael Luckett, 21, was heading north on Darmstadt Road when he became distracted trying to find his phone to answer it. Deputies say he drove off the road and into a tree.

The passenger, Tyler Riney, 24, was ejected. We’re told he was not wearing a seat belt. Luckett was wearing a seat belt and was not hurt.

Authorities say the truck rolled onto Riney after he was ejected, and bystanders had to help free him. He was taken to the hospital with serious injuries.

Deputies say while texting and driving is against the law in Indiana, the use of a cellular device to make phone call while operating a motor vehicle is still legal.
